Estate planning is the process in which individuals arrange the transfer and preservation of assets in the event of their incapacity or death. Comprehensive estate planning will ensure that an individual’s physical person and property will be managed properly if an unforeseeable or inevitable event occurs. Putting The Pieces Together

There are a number of legal documents we use as appropriate for each client. When I have discussed your goals and assets with you, I will recommend some or all of the following documents:

  • Trust: A trust is an estate planning instrument used to hold assets on behalf of a beneficiary or beneficiaries. A properly drafted trust allows the estate to avoid any costs associated with probate.
  • Last will and testament: A last will and testament is an estate planning tool used to designate a representative to distribute the assets of an estate to the beneficiaries through the probate process. You can also name guardians for minor children in your will.
  • Financial power of attorney: A financial power of attorney is an estate planning document drafted to appoint an agent to manage an individual’s financial affairs in the event of incapacity.
  • Medical power of attorney: A medical power of attorney is a document drafted to appoint an agent to make medical decisions on an individual’s behalf in the event of incapacity.
  • Advance directive: An advance directive/living will is the written intent and instructions of an individual regarding end-of-life medical treatment.
  • HIPAA release: A HIPAA release is an authorization to disclose the medical information of an individual to those listed in the document. A HIPAA release is typically coupled with a medical power of attorney.
